Can I Avoid Foreclosure?

If you are three or more months behind on your real estate mortgage payments and have no options for getting a loan to cover the amount of past due payments, your finance company may start foreclosure proceedings. The bank will sell your house at a Sheriff’s sale to pay the mortgage, but you will still be responsible for any remaining balance on the mortgage that is not covered by the sale.

Your bank is not required to accept an amount less than the total amount of the mortgage.

However, if you file for Chapter 13 bankruptcy protection, you may be able to take back control of your mortgage payments and possibly keep your home. With a Chapter 13 bankruptcy, the court will develop a payment plan for you to pay off outstanding credit card debts, including your past due mortgage payments, over a three- to five-year period.

Many people refuse to even consider bankruptcy, believing that it will have a disastrous effect on their ability to rebuild their credit later. This is a bankruptcy myth.

Walk Away from Your Mortgage

If you are behind on your mortgage payments and cannot see a way to get back on schedule — you may want to simply "walk away." You cannot just walk away from personal liability without filing for Chapter 7 bankruptcy, if you qualify, to protect yourself from the bank’s efforts to collect what it is owed in any way possible.
